Inauguration of the Commissioner of the National Collective Management Organization Period 2019-2024

To protect the owner or holder of Intellectual Property Rights (IPR) over copyright and related rights, especially in terms of economic value in the field of song and music, it is necessary to have an organization that manages management in this regard. Therefore Law Number 28 of 2014 concerning Copyright regulates this matter, namely royalties.

According to Law Number 28 of 2014 concerning Copyright Article 89, management of Copyright royalties in the field of songs and music is formed by 2 (two) National Collective Management Organization (LMKN), each of which represents its representation, namely the Creator LMKN and the Related Rights LMKN.

The LMKN is a government aid agency for Non-State Revenues and Expenditures (Non-APBN) that obtains attribution authority from the Copyright Act to attract, collect and distribute Royalties and manage the economic rights of the Creator and the Related Rights owner in the field of songs and / or music.

The LMKN itself is inhabited by 10 (ten) Commissioners selected through open selection. The first LMKN commissioner has entered full service on January 19, 2018.

To fill this vacancy, on October 1, 2018 the Directorate General of Intellectual Property (DGIP) of the Ministry of Law and Human Rights (Kemenkumham) forms a Selection Committee based on Decree Number: HKI-066.KI.01.08 in 2018 concerning the LMKN Selection Committee Creator and LMKN Related Rights in the Field of Songs and / or Music.

The Selection Committee then opens the admission of prospective LMKN Commissioners from the 5th (fifth) to the 23rd of November 2018. Of the 45 prospective Commissioners who register, finally 9 (nine) Commissioners are elected, and one Commissioner will be filled by Government representatives from Department of Law and Human Right (Kemenkumham) who will manage and supervision in the field of Copyright and Related Rights.

The following are nine selected LMKN Commissioners:

  1. Yurod Saleh, S.H., M.H;
  2. Ir. James Freddy Sundah;
  3. Rapin Mudiardjo Kawaradji, S.H., ACCS, S.Kom., CIP., CPL;
  4. Marulam Juniasi Hutauruk, S.H;
  5. Rien Uthami Dewi, S.H;
  6. Irfan Aulia, S.Kom;
  7. Ebiet G. Ade;
  8. Yessi Kurniawan, S.T;
  9. Adi Adrian.

The selection and inauguration of the LMKN Commissioner refers to the provisions of Article 87 of Law Number 28 of 2014 concerning Copyright and Minister of Law and Human Rights Regulation No. 36 of 2018 concerning Procedures for Application and Issuance of Operational Permits and Evaluation of Collective Management Institutions.

The Ten Commissioners will serve for 5 (five) years and can be re-elected for the next 1 (one) term of.
